We introduce the notion of a dice model as a framework for describing a class of probabilistic relations. We investigate the transitivity of the probabilistic relation generated by a dice model and prove that it is a special type of cycle-transitivity that is situated between moderate stochastic transitivity or product-transitivity on the one side, and Lukasiewicz-transitivity on the other side. Finally, it is shown that any probabilistic relation with rational elements on a three-dimensional space of alternatives which possesses this particular (...) type of cycle-transitivity, can be represented by a dice model. The same does not hold in higher dimensions. (shrink)

We introduce two extreme methods to pairwisely compare ordered lists of the same length, viz. the comonotonic and the countermonotonic comparison method, and show that these methods are, respectively, related to the copula T M (the minimum operator) and the Ł ukasiewicz copula T L used to join marginal cumulative distribution functions into bivariate cumulative distribution functions. Given a collection of ordered lists of the same length, we generate by means of T M and T L two probabilistic relations Q (...) M and Q L and identify their type of transitivity. Finally, it is shown that any probabilistic relation with rational elements on a 3-dimensional space of alternatives which possesses one of these types of transitivity, can be generated by three ordered lists and at least one of the two extreme comparison methods. El término '"Dialéctica" hace referencia tanto al movimiento de autodesenvolvimento del concepto - en este caso el de derecho y, em sentido amplio - como a la estrutura de ese movimiento, al cual Hegel trata de encuadrar en esquemas provenientes de la Lógica dei concepto, especialmente en la triada 'tesis - antítesis - síntesis', lo cual potencia la complejidad dei texto y dificulta su comprensión. Uma hermenéÚtica esclarecedora de la lógica dialéctica en juego, donde a la contradicción!e cabe el papel (...) protagónico, exige tener en cuenta estos aspectos como también e: hecho de que Hegel, en su concepción de la Dialéctica asume la herencia de la filosofia aristotélica, tanto como del Idealismo Trascendental moderno, los que se entremezclan permanentemente en intrincada red de múltiples significaciones. La distinción de todos estas aspectos y de su rol en la exposición de la Filosofia del Derecho es imprescindible, tanto para una interpretación adecuada de su letra y espíritu, como de su significación actual. El presente trabajo se concibe como un intento de contribuir ai esclarecimiento de esta cuestión. (shrink)

Die Geltung von Entschädigungsansprüchen für historisches Unrecht wird in der philosophischen Literatur vor allem aus zwei Gründen bestritten: auf Grund des Nichtidentitätsproblems und auf Grund der von Jeremy Waldron behaupteten möglichen Aufhebung historischen Unrechts durch die Veränderung von Umständen. Für die Beurteilung des Rechts der palästinensischen Flüchtlinge auf Rückkehr sind beide Einwände nur von geringer Bedeutung. Die Palästinenser sollten jedoch auf ihr Recht auf Rückkehr vorläufig verzichten , um einen Kompromiss zu ermöglichen, der es ihnen erlaubte, ihr Selbstbestimmungsrecht in einem (...) Teil ihres Heimatlands zu realisieren. Eine solche Zwei-Staaten-Lösung könnte sicher helfen, die Grundrechte von Israelis und Palästinensern zu sichern und die Voraussetzungen für eine Versöhnung der verfeindeten Gruppen und für gerechte Verhältnisse in der Region zu schaffen.
